Apple et Amazon renoncent aux poursuites sur le nom "app store"

(Reuters) - et Amazon.com ont mis un terme leur contentieux judiciaire sur le droit d'utiliser le terme "app store", ce qui devrait permettre aux deux groupes de continuer l'employer.

La juge Phyllis Hamilton d'Oakland (Californie) a ordonné mardi le classement de l'affaire la demande des sociétés concernées, annulant ainsi le procès initialement prévu le 19 août.

Alors qu'Apple commercialisait des applications pour terminaux mobiles sur son service en ligne App Store depuis juillet 2008, Amazon avait lancé son Amazon Appstore pour le système d'exploitation Android en mars 2011. Apple avait engagé des poursuites quelques jours plus tard.

Le groupe la pomme accusait Amazon de violation de marque déposée et de publicité mensongère. Le géant du commerce en ligne répliquait que l'appellation "app store" était tellement répandue que son utilisation ne risquait pas de tromper les clients.

En janvier, la juge Hamilton avait rejeté le chef de publicité mensongère.

"Nous ne jugeons plus nécessaire de continuer défendre ce dossier", a déclaré mardi une porte-parole d'Apple. "Avec plus de 900.000 applications et 50 milliards de téléchargements, les clients savent où ils peuvent acheter leurs applications favorites."

De son côté, Martin Glick, un avocat d'Amazon, a déclaré Reuters qu'il s'agissait d'"une décision unilatérale d'Apple de renoncer aux poursuites et de laisser Amazon libre d'utiliser le terme 'app store'".
